Back in 1994, a
woman sued McDonald’s over product liability because her coffee was too hot.
Thirty years
later, we have the complete opposite.
Karla Quinonez has
filed
a lawsuit against JetBlue Airways for being served ice cream that she said
was “dangerously cold.” She claims she broke an incisor while on her way to
Paris. We are not making this up. For the record, the ice cream in question was
a sandwich. No word on passengers who might have tried a Nutty Buddy.
Quinonez filed the
suit in federal court. She said the flight crew should have warned her that the
ice cream sandwich was rock hard.
“The ice cream
sandwich that Defendant served to Plaintiff was frozen solid and caused
Plaintiff to sustain severe bodily injuries, including a root fracture of tooth
number 10,” the complaint reads.
JetBlue did not
comment.
The incident
happened in August on a flight from John F. Kennedy International Airport in
New York City. The suit claimed that the incident required emergency surgery in
Paris upon landing as well as subsequent care. According to court documents,
the pain was caused by JetBlue’s “negligent acts.”
She is demanding a
money judgment.
There does not appear
to be a precedent for this case. Unless somebody comes forward claiming the
same injuries from an eclair or similar frozen treat
