Erin Andrews' Negligence Lawsuit Against Nashville Marriott Goes To Trial

Reporter and television host Erin Andrews returned to Nashville Monday to begin her negligence lawsuit against a Marriott hotel after she was videotaped getting undressed during a 2008 visit.

According to Stacey Barchenger of The Tennessean, Andrews is suing for $75 million in damages after she accused the hotel and its employees of allowing Michael David Barrett to book a room next to hers.

Barrett was convicted of interstate stalking for, in part, creating peepholes that looked into the adjacent room so he could film Andrews changing her clothes. Documents obtained from the original lawsuit indicate the accused then posted the videos on the Internet.

Following the incident in 2008, Barrett was arrested and sentenced to 30 months in prison.

The latest lawsuit is against the Marriott at Vanderbilt University, Windsor Capital Group and Barrett, and Andrews is accusing the hotel of "negligence, infliction of emotional distress and invasion of privacy."

While Andrews was unsuccessful in her lawsuit against Marriott International after a judge ruled the franchisor as not liable, the case has moved forward against the individual hotel and the people involved in the incident.

Marriott International released an official statement on the pending case to The Tennessean:

"As we have maintained since this matter first came to our attention, however, Marriott International was not responsible for what happened to Ms. Andrews, and we are pleased that the Court has dismissed Marriott International from the case. Marriott International continues to be sensitive to the serious nature of this matter and remains committed to the safety and comfort of our guests."
