AMResorts said it is fighting a decision by the owners of Secrets Marquis Los Cabos to remove the company as the property's sales, marketing and branding representative.
"Despite our successful relationship in providing sales, marketing and brand management services for Secrets Marquis Los Cabos, our partner KM Promotions has unexpectedly decided to begin operating the resort as Marquis Los Cabos," according to a statement from AMResorts.
The property has been shuttered in the aftermath of Hurricane Odile and was scheduled to reopen on Dec. 20. A posting on the Secrets Marquis Facebook page said it would remain closed until further notice. No further information was available regarding a reopening date for the resort.
AMResorts, however, is not going down without a fight.
"AMResorts is currently under contract with KM Promotions," the statement said. "When our executive team was unexpectedly notified of the ownerships' decision to operate as Marquis Los Cabos and not under the Secrets Resorts & Spas brand, AMResorts initiated action to resolve the matter. We are currently in discussion with KM Promotions regarding the terms of the contract and legal action is underway."
"AMResorts is proactively communicating with currently booked guests enabling them to make any changes they wish," said an AMResorts spokesman. "These guests are able to rebook at any other AMResorts property at the exact same rate for which they booked or can cancel their reservation without penalty."

AMResorts' removal as the operator of the Marquis property is strangely reminiscent of a similar Los Cabos property dispute.
Last month, CarVal, a co-owner of the Capella Pedregal in Los Cabos, seized management of the property, renaming it the Resort at Pedregal, ending its affiliation with the Capella brand.
In a back-and-forth battle, a New York Supreme Court denied Capella Hotels & Resorts the authority to reclaim the property.
