Competition among Las Vegas hotels has always been fierce.
Now the Wynn Las Vegas is taking it to another level.
The Wynn has filed a lawsuit against fellow hotel Fontainebleau alleging that the new property poached some Wynn employees. Fontainebleau opened in December after a series of starts and stops that lasted almost two decades.
The lawsuit was filed in Clark County District Court.
It alleges Fontainebleau Las Vegas solicited Wynn executives and high-ranking employees, even encouraging some to break their current contracts.
"Clearly, we want all operators in Las Vegas to be successful; it's good for the city in which we all live," Wynn Resorts said in a statement. "We just want that to happen without interference in the contractual agreements our employees have negotiated with us."
Fontainebleau Development said the company does not comment on pending litigation.
The lawsuit spells out that Wynn employees have a non-compete clause in their contracts and cannot solicit fellow employees in taking another job. The lawsuit claims that this has been going on for more than a year, and that the Fontainebleau wood start executives off at its signature property in Miami to get around the non-compete provisions. This way, it could later say that the executives asked to be transferred back to Las Vegas.
There was a temporary restraining order requested in 2022 in which the Fontainebleau agreed it would not try to steal any employees. Wynn is asking for another restraining order to block any future poaching, along with real and punitive damages.
